Terms and conditions

These terms govern the use of the Hail Calculator service offered by VDE.

This text was drafted as a template for the Belgian SaaS market. We recommend you have it legally reviewed for your situation.

1. Service provider

This service is provided by VDE, company/VAT number BE0789230701. Contact: info@vde.be. Referred to as “VDE” or “we”.

2. Subject

VDE offers “Hail Calculator”, a SaaS application that lets professionals calculate hail damage using the UPEX grid. The service is provided “as-is” on a monthly subscription basis.

3. Formation of the agreement

The agreement comes into effect once the customer registers on the website and accepts these terms. The customer declares to be of legal age and authorised to bind the company.

4. Price and invoicing

The price is €49 (excl. VAT) per user per month. Invoices are sent monthly afterwards by email. Payment is due within 14 calendar days of the invoice date. In case of late payment, statutory interest is due by operation of law and without notice, together with a fixed indemnity of 10% with a minimum of €40.

5. Non-payment and blocking

In case of late payment, VDE may temporarily block access to the account until full payment is received. The customer's data is preserved during this period and becomes available again after settlement.

6. Duration and cancellation

The agreement is for an indefinite period and can be cancelled monthly by either party by email to info@vde.be. Months already invoiced or in progress remain payable.

7. Data and GDPR

Data entered by the customer (customers, vehicles, calculations) remains the customer's property. VDE acts as processor and stores the data on secure European servers as long as the account is active. The customer can request export or deletion at any time via info@vde.be. 8. Liability

VDE makes every effort to deliver an accurate and available service but does not warrant error-free operation or continuous availability. The Hail Calculator is a tool; the customer remains ultimately responsible for the prices and reports issued. VDE's liability is in any case limited to the amount paid by the customer in the three months preceding the damaging event.

9. Changes

VDE may amend these terms and prices with at least 30 days prior notice by email. Changes unfavourable to the customer entitle the customer to cancel free of charge before they take effect.

10. Governing law and jurisdiction

This agreement is exclusively governed by Belgian law. Disputes fall under the exclusive jurisdiction of the Enterprise Court of Antwerp, Antwerp division.
